Trademark law is complicated. In the United States, common law gives rights in a trademark to the first one to use it in commerce. So even if a trademark is successfully registered on the federal trademark register, a so-called common law trademark which was in use prior to the federal trademark application may be able to sue for infringement. This is why a search is so important, which we perform for you in two parts:
- The first is a cursory "knock-out" search which in effect will "knock-out" any possible conflicting marks.
- If the mark is considered a potential, adoptive, mark, we begin the next level of clearance which involves a comprehensive search and preparation of the trademark registration.
Our firm offers a flat rate fee for the trademark application. This covers the search, the application and responding to non-substantive office actions from the United States Patent and Trademark Office (USPTO). We also offer trademark renewal services.
